The creator of a photograph is the owner of the copyright, unless they're in employment where copyright generally belongs to their employer. This however depends on the contractual agreement between the two parties.
Under UK law, only the copyright owner can licence the use of a photograph by a third party. This means reproducing the work in any form, including the storage of work in any medium or electronically.
Copyright for creative work such as photography lasts the lifetime of the creator plus 70 years. So unless you give a third party permission to use your work, if it is used there will be a copyright infringement taking place.
